In England, the Valuation Office Agency considers whether an annexe is a separate “dwelling” for Council Tax purposes. The key question is not simply whether the building is in the garden, but whether it can function as independent living accommodation.

Furthermore, when you may not pay the full amount

Even if the annexe is separately banded, that does not always mean you pay a full second Council Tax bill. Relief may apply depending on who lives there and how the annexe is used.

If the annexe is occupied as the main home of a dependent relative, it may be exempt. This commonly applies where the relative is aged 65 or over, severely mentally impaired, or substantially and permanently disabled. If the occupier is a non-dependent relative of someone living in the main house, a 50% Council Tax reduction may be available instead.

An empty annexe may also be exempt in some cases, especially where planning restrictions mean it cannot be sold or let separately from the main property. Local councils usually require evidence before applying an exemption or discount.

If your annexe is being used by a member of your family and a separate band is issued, you should appeal this. Don’t get distracted by annexe exemptions and discounts. The annexe should simply not be “listed” at all

Be ready to explain who lives in the annexe, whether they are related to the main household, whether the annexe is their sole or main residence, and whether any planning restriction prevents separate letting or sale.

In short: you may only need to pay Council Tax on a garden annexe if it is treated as a fully independent separate dwelling, ie Airbnb or for a paying lodger.
